EMINENT DOMAIN BILL PASSES NC HOUSE

“The House on Thursday approved a proposed change that would enshrine eminent domain protections into the N.C. Constitution. It’s been sought by a number of lawmakers since the 2005 U.S. Supreme Court case that said it was permissible for a Connecticut town to condemn private property for private economic development.

The eminent domain constitutional amendment was attached to an unrelated bill dealing with the Wildlife Resources Commission.

If the Senate goes along with the House on the constitutional amendment, North Carolina voters would be given the opportunity to ratify the proposed change during the Nov. 4, 2014, general election.

All constitutional amendments in North Carolina require a ballot vote, which is the first part of the proposal below. The proposal was attached to a boating law and wildlife related bill (s636) and the text is as follows:”
