City to discuss Moongate Water Co., at Tuesday meeting
“City councilors on Tuesday will consider rescinding a 2011 resolution in which they voted to pursue using eminent domain to take over Moongate Water Co. infrastructure.
The step would be a precursor to a proposed settlement agreement relating to a 2006, anti-trust lawsuit by the privately owned East Mesa water company against the city, according to agenda documents.
If the proposed rescinding of the eminent domain resolution isn’t OK’d by councilors, “the settlement agreement will be of no effect, and potentially the city and Moongate will proceed to trial” in the anti-trust lawsuit, according to agenda documents.
The meeting starts 3 p.m. Tuesday at Las Cruces City Hall, 700 N. Main St.”
