Portsmouth must remove sewer line, or take land by eminent domain
“A judge has ruled that the city must remove a public sewer line running through Toyota of Portsmouth land owned by Jim Boyle or “obtain easement rights by eminent domain within a reasonable time.”
The ruling by Rockingham County Superior Court Judge N. William Delker finds that a segment of city sewer line is trespassing on Boyle’s property and that Boyle must be compensated for the time between Nov. 12, 2013, and when the line is removed, or easement rights are obtained. The amount of compensation would be determined during a jury trial, the judge ruled.
Nov. 12 is when Boyle notified the city, in writing, that he was revoking the city’s easement for the sewer line to run through his Greenleaf Avenue dealership property.”
