Appeals court denies Dillard’s delay
“The Colorado Court of Appeals ruled Friday that it will not put a hold on the transfer of Dillard’s title to the Longmont Urban Renewal Authority while it reviews the case. LURA wants the title to the chain’s store in the Twin Peaks Mall so that an $80 million mall redevelopment project can go forward.
Normally, that would mean that a panel named by the Boulder District Court can go ahead with setting a preliminary value for the store, so that title can be passed, or “vested.” But things aren’t normal. In a separate motion, LURA said it would waive its right to that vesting hearing, if the court would set a trial date before the end of 2013.
“LURA’s goal remains the same — to keep the Twin Peaks Mall urban renewal project on track,” the urban renewal authority’s attorneys wrote to Judge D.D. Mallard. “A prompt jury trial in 2013 remains the best way to ensure that occurs.””
