State Supreme Court denies Lower Makefield request for new trial in eminent domain case, township to pay additional $3.3M for golf course land

“The Pennsylvania Supreme Court has rejected the township’s request for a new trial in an eminent domain case involving the township’s 1999 eminant domain acquisition of the 166 acre Dalgewicz Farm on Woodside Road, the current site of the Makefield Highlands Golf Course.

As a result of the state high court’s unanimous 10-page ruling, the township will owe the property owners an additional $3.3 million, which also includes the interest which has been accruing at more than $10,000 a month since the 2008 jury award.

That brings the total purchase price to more than $7.3 million in principal and interest that Lower Makefield will be paying to the Dalgewicz family for the land. The township has already paid the family $4 million.”
