Eminent domain, General Plan report on Chico City Council agenda
“Leading the regular agenda is an eminent domain case that spurred lengthy discussion at the council’s April 2 meeting. After another meeting with the property owners, negotiations remain at a standstill and city staff is recommending the council approve eminent domain to ensure viability of an planned project.
The desired property is part of a bike path designed to run from Little Chico Creek to Community Park. All other necessary property acquisitions have been finalized.
Owners of the residence at 1377 Humboldt Ave. have expressed concerns about the impact of the bike path with regard to trespassers, potential impacts to their ability to use septic tanks, and that they have not been offered appropriate land value.
Adopting the resolution does not preclude ongoing negotiations with the property owner, but establishes the mechanism for the city to take possession of the property if necessary.”
