“Dunwoody City Council members approved the use of eminent domain for right-of-way and easement areas along 4962 Tilly Mill Road, a corner lot that is currently undeveloped, in a meeting last week.
The acquisition of the land was needed in order to solve safety and traffic issues along the North Peachtree, Tilly Mill and Peeler roads intersections due to “an unacceptable level of service, particularly during the peak of the morning commute,” according to a traffic analysis conducted in 2011.
“The project itself is one we’ve been working on for a while as part of our comprehensive transportation plan’s safety and operational improvements,” said city spokesman Bob Mullen.
Mullen said after the analysis was conducted, a design that addressed efficient automobile flow, provided sidewalks for pedestrians and improved safety was drawn up.
Capital Projects Manager Mindy Sanders presented documents to the council that showed the city “has not received a favorable response,” to previous acquisitions of the property from the owner, Gustavo Real.
“The property owner, through their attorney, has been provided a best and final offer of $25,000 for the property, however the city has not received a favorable response and the last counteroffer was sent in November for $38,000,” she said.
