Pa. High Court Rejects Water Authority’s Eminent Domain Bid
“Law360, Philadelphia (September 25, 2014, 4:32 PM ET) — The Pennsylvania Supreme Court ruled Wednesday that a municipal authority could not use eminent domain to condemn an easement on privately owned land in order to allow a private developer to install a sewer drainage line for a proposed residential project.
In a unanimous decision, the high court reversed a Commonwealth Court decision that okayed the Reading Area Water Authority’s bid to take land from the Schuylkill River Greenway Association to aid Fortune Development LP’s efforts to build a 219-unit subdivision in Berks County.”
