Judge: No retrial on ‘Domain’
“Rock County Judge Barbara McCrory ruled Tuesday the jury’s verdict in the eminent domain case involving Anna Truckenbrod’s land at 2570 Milwaukee Road, Beloit, which the School District of Beloit took over, will stand and there will be no new jury trial.
The jury valued Anna Truckenbrod’s land at $382,000 in a verdict on May 21.
“It’s the jury’s providence to judge credibility of evidence witnesses,” McCrory said.
McCrory said she will write an opinion on who will pay the legal expenses and will determine the value of those expenses.
In Tuesday’s arguments before the judge, the School District of Beloit’s attorney Brad Dagen argued the jury was forced to speculate on the land value because the expert witnesses on behalf of the Truckenbrods didn’t present credible evidence on the Beloit market along Milwaukee Road. The Truckenbrod’s attorney, Erik Olsen, however, argued the credibility of a witness is for the jury to decide.”
