Jury deliberations in eminent domain trial could begin today

“Jury deliberations are expected to begin this afternoon in the eminent domain trial between plaintiffs Tim and Annette Bice and the defendant, the city of Clinton.

The plaintiffs’ attorney, Michael McCarthy, and the city’s attorney, J. Drew Chambers, rested their cases this morning. Both attorneys called their own appraisers to the stand to testify about the value of the 21 acres of land in question.

The Bices first filed suit against the city in March 2012, claiming the city took unconstitutional actions after he was denied vehicular access to the property near Eagle Point Park along an unimproved right-of-way from Cragmor and Lakewood drives. The lawsuit was deemed irrelevant as a result of the city’s eminent domain proceeding. The plaintiffs filed an appeal in November, claiming they deserve closer to $221,000 for the property, rather than the $100,000 assessed by the Clinton County Compensation Commission.
