Lawsuit filed related to massive downtown Dayton project
“A neighbor to downtown’s new Water Street district has filed a lawsuit related the project.
Dave Reed, a lawyer with Taft Stettinius & Hollister LLP, said a lawsuit has been filed by Dayton Office Properties, which owns the office building at 409 E. Monument Ave., who have said the city has wrongfully taken their land to support the development.
The $33.5 million project has a 50,100-square foot office building under construction with a 400-spot parking garage and about 220 residential units planned. Those are expected to break ground in the first week of July.
Reed spoke to the city commission in November, saying the city is taking land from his client through eminent domain for the roadway improvements, and an agreement was signed in 1996 that the area being used to redevelop Water Street not be used for vehicular traffic for 90 years.”
