Midland procures properties for sewer corridor, stream realignment

“Midland leaders moved forward with several projects at their Tuesday meeting, including exercising eminent domain on several properties in a planned sewer corridor and realigning a stream in the future Main Street district.

As part of its Cabarrus Acres Phase 1 sewer project the town has been able to procure 15 of 28 necessary easements to begin construction.

They have attempted to contact the property owners of the rest of the parcels but have either been unable to contact them or unable to reach an agreement, according to the meeting agenda. No property owners spoke at Tuesday’s meeting.

The council passed several resolutions condemning the properties and allowed the city to move ahead with the “notice to proceed” portion of a construction contract with Propst Construction Co. Inc.

The eminent domain actions are “essential for meeting the project timeline,” the agenda read.
Town attorney Anthony Foxx noted property owners still have the ability to negotiate with the town council on the compensation amount before action is taken.
The resolutions passed unanimously.
The council passed three resolutions related to a plan to realign 400 feet of stream in the future Main Street district.

The council decided to contract with environmental consultant Leonard Rinder for a rate not to exceed $13,625.”
