Sanitary board to use eminent domain for Red Brush project
“The Beckley Sanitary Board is in Phase III of its project in the Red Brush neighborhood. Standing in the way of completion however, are nearly 50 properties where the owners won’t sign right-of-way easements.
Board members said they would grant a July 15 deadline for those signatures before it begins the process of eminent domain, which would force property owners to allow the board go through the properties.
Some of those properties are tied up in heirships, including a vacant lot that has been in probate since 1935.”
