Franklin: Landowner Loses Appeal In Pipeline Construction Case
“Waco’s 10th Court of Appeals on Thursday denied an appeal from a Robertson County man who claimed a pipeline construction company illegally gained easement to his land through eminent domain.
Edgar Todd Love asked the appeals court to review an 82nd District Court ruling on the eminent domain issue because he said he was not properly notified that the Texas Express Pipeline Company was taking easement through a piece of property that he says belonged to him.
The pipeline company is building a pipeline to move liquefied natural gas from the Texas Panhandle to the Gulf Coast.
But appeals court documents show the company, through county land records, established that the piece of property in question belonged to a man named Milton Hammond, who was deceased.
In his appeal Love claimed he is Hammond’s grandson and that the land had been conveyed to him through inheritance.
Love, however, had never produced any documents to either the 82nd District Court or to the 10th Court that showed his ownership of the piece of land in question.”
