Eminent domain dispute on Alice’s Road corridor dismissed

“An independent attorney contracted by the city of West Des Moines has issued an opinion dismissing the claims of a resident who believes the city unlawfully seized her land for construction along the Alice’s Road/105th Street corridor five years ago.

Former Iowa Supreme Court justice Mark McCormick said Linda Robel’s claims that the city unlawfully used eminent domain are moot because of a 2010 settlement agreement between Robel and the city. The opinion was part of a six-page letter McCormick sent to West Des Moines elected officials this week.

Robel dropped a lawsuit in 2010 after West Des Moines agreed to pay her more than $320,000 for damages and related costs on property originally purchased for $204,000.”
