Pooler to use eminent domain for first time
“After avoiding its first use of eminent domain in a recent property dispute with a local family, the city of Pooler intends to use it in a separate matter to build a parking lot.
On Monday, Pooler City Council members voted unanimously in favor of a resolution to approve a declaration by taking 1048 S. Rogers St. in order to construct additional parking and provide easier access to nearby Pooler Park.
The city has been working during the past two years to buy the 2.7-acre property. A deal with land owners had been reached and a purchase contract was signed when officials discovered the owners did not have clear title to the property.
County tax records list the “heirs of Ben Simon,” but there is no deed that shows title to the property has ever been transferred since the death of Ben Simon, who apparently was the last recorded owner in the 1920s. He died, city attorneys said, without a will.”
