Judge to rule on whether Readington can change lawsuit against airport
” A Superior Court judge will decide by Nov. 8 whether Readington Township will be allowed to change its eminent domain suit against Solberg Airport so the municipality can acquire all of the aviation facilities on the property.
Attorneys for Readington Township and Solberg Airport argued Thursday afternoon before Superior Court Judge Yolanda Ciccone, who has already set a March 14, 2014 trial date for the lawsuit that began seven years ago.
The legal battle began when the township adopted an ordinance that identified the acquisition of the airport property as essential to avoiding residential development of the 725 acres. At that time the township was seeking to buy 625 acres of open space on the tract and acquire the development rights to the remaining 100 acres where the aviation facilities are located.
Now Readington wants to acquire through eminent domain the entire 725 acres.”
