Canandaigua lakefront eminent domain decision again delayed

“A decision to determine whether former Lakeshore Drive property owner Dan Homik received just compensation following the city of Canandaigua’s 2009 decision to use eminent domain to acquire his property has been delayed this month for the second time.

The deadline that both Homik and the city had to file concluding arguments in the case was pushed back from Sept. 16 to Sept. 30, said a representative of Judge William Kocher’s office. Both sides agreed to the extension, the rep added. The original deadline was Sept. 3; however, that was pushed back to Sept. 16 earlier this month to give both sides at least 90 days after June 16 — the day they each received final transcripts of the trial — to file the summations.”
