Harvey Cedars couple Harvey and Phyllis Karan agrees to $1 settlement in eminent domain case
“The couple that argued they were entitled to big money for the loss of their oceanfront view after a protective sand dune was built on their land has agreed to a $1 settlement.
The Borough of Harvey Cedars used eminent domain to take part of Harvey and Phyllis Karan’s land.
A lower court initially awarded them $375,000, but the ruling was appealed to the Supreme Court of New Jersey. The state’s top court ruled that the award was unjustified, saying that the protection offered by the dunes should have also been considered.”
