City update on Sycamore North eminent domain
“Staff continues to work on acquiring necessary easements on “R Alley” that are necessary for emergency access and will enable the completion of the Sycamore North building immediately adjacent to R Alley. Due to delays caused by the Bayside Home Owners Association Board’s initial and continuing refusal engage in negotiations, the City Council approved a Tenth Amendment to the Purchase Agreement to extend the deadline for close of escrow. The City Council also scheduled a Special Meeting for August 20, 2013 to consider a Resolution of Necessity, which is a necessary step in taking a public right of way easement by eminent domain. The Council also directed staff to make all reasonable efforts to negotiate an agreement with the Bayside Home Owners Board and thus avoid litigation. “
