Fremont City Council OKs eminent domain on bank

“Fremont City Council voted unanimously Tuesday to adopt a resolution of necessity to authorize eminent domain seizure of private property, generally for public projects and relocation of current tenants at 39138 Fremont Blvd. for the downtown area project.

Despite objections from property owner Fremont Capital Group LLC and one of the current tenants, Citibank, the council approved acquisition of the property.

Charles Deem of DLA Piper Law Offices spoke on behalf of Citibank, saying that the bank did not oppose the project, and has found a new site to move to. However, it would not be able to meet the federal requirements for the transfer to the new site within the timeline the city has set.
