Judge: $1.25 million award OK for old York County Prison
“The Redevelopment Authority of the City of York’s claims for a new eminent domain trial have no merit, and it must pay $1.25 million for the site of the old York County Prison, a judge has ruled.
In a 27-page opinion, Senior Judge Robert J. Eby wrote on Jan. 9 that the jury’s award was “directly supported by the thorough and credible testimony” of John and Joyce Gearhart’s expert. They bought the old York County Prison, which is on Chestnut Street near PeoplesBank Park in York, for $51,500 in 1982. It has sat vacant for decades.
The RDA initiated eminent domain proceedings in 2014. The Board of Viewers later awarded $65,000 — plus $4,000 for attorneys’ fees — for the site. But in July, a jury took less than 30 minutes to decide that the property was worth $1.25 million.”
