Judge denies two more Mountain Water motions in condemnation case
“Missoula County District Court Judge Karen Townsend has denied two more motions in the Mountain Water condemnation suit, telling the utility it’s not entitled to money for improving the water system over the past year.
Mountain Water is fighting the City of Missoula’s attempt to take over ownership of the utility through the condemnation process.
Mountain Water had asked Judge Townsend to rule it was entitled to additional “just compensation” for more than $6 million in capital improvements the company has made to its infrastructure since the city filed the condemnation proceeding last year. “
