Nichols files bill prohibiting eminent domain for parks
“Montgomery County lawmaker Robert Nichols, R-Jacksonville, wants to prohibit government bodies from condemning land, or eminent domain, for recreational purposes.
Nichols, a state senator in his third session, filed Senate Bill 178, which would forbid state and local governments from taking private land that would be used for park space or for a parks and recreation system.
“No homeowner should lose the roof over their head so others can have a place to play,” Nichols said. “Eminent domain should never be used for recreational purposes, period.”
