The city says it may consider the use of eminent domain to purchase land for construction of the store. At issue are two businesses located on land needed to build access roads for the Wal-Mart to be built in the Gilmer-Reel road area. The landowners have made no agreement to sell, and legally the city has authority to purchase the property under eminent domain, if it is deemed public necessity.

Homeowners in the area are still angry at the store’s construction in their neighborhood and feel that if the city can force a business to sell its land , then it could also happen to them. The issue will be taken before city council on Thursday.”
